I think you should know he gets his name from the plant nightshade. I plan on this being a darker comic, in which Nightshade kills the criminals. I was debating whether or not to give him knives, or whether that might be a little to gory. Also, whether he would be based I a real city( New York, Boston, etc.) or a fictional city(Gotham City, Metropolis, etc.). Input would help me arrive at a conclusion for both these questionable actions.

He only does it when absolutely necessary and lives are at stake. He does not just kill petty thieves and all that. Just murderers and the like.

In a way he is. He has a split personality. His identity, Ronald Ruel Chesterton, wouldn't hurt a fly, and his Nightshade persona is willing to stop crime buy any means necessary.

For example, look at all the old westerns from the '50s and '60s. The heroes in them like Lucas McCain, Josh Randall, Jonny Yuma, etc. use deadly force when necessary.

I'd like him better if his other personality made him not in control of his actions at all really. Then it wouldn't be his fault if he killed

Which other personality? What I had planned was that R. R. Chesterton had no idea of his other personality and was not conscious of what Nightshade did. Nightshade however, was conscious of what Chesterton did, and could choose whether or not o manifest himself and take control at night.
